Terms of Service

Your account

1. You are responsible for keeping your password secure, and for making sure anyone you give access to your business’s account does the same. We are not liable for loss or damage caused by a failure to keep sign-in details secure.
2. You are responsible for what is submitted and done under your business’s account, including by people you have added to it.
3. The information you give us must be accurate, and you must keep it up to date.
4. You must be a person. Accounts registered by bots or other automated methods are not allowed.
5. The Portal is for business use. You must be at least 18 years old to use it.

Quotes, orders and payment

1. A quote request is a request, not an order. Nothing is ordered until we send you a quote and you approve it.
2. A quote is based on the details you give us, including vehicle, engine and part information. If those details are wrong or incomplete, fitment, price and availability may change, and we will tell you before going ahead.
3. Prices, availability and expected dates are estimates until confirmed. Suppliers sometimes change them, and when that happens we will tell you.
4. Payment, returns, warranties and core charges for parts are handled the same way as any purchase from us at the counter or over the phone, and are not changed by these Terms. Ask the parts desk if you have questions about a specific order.
5. Where tax applies, it is added to the price. If you tell us you are tax exempt, you are responsible for giving us a valid exemption certificate and keeping it current.

Closing an account

1. You can ask us to close your account at any time by contacting the parts desk at parts@mauricetowntruck.com or (856) 785-3222. What happens to your information afterwards is described in our Privacy Policy.
2. We may suspend or close an account, or refuse service, if these Terms are broken, if the Portal is being misused, or to protect our customers, our staff or the Portal itself.
3. Verbal, physical, written or other abuse of our staff, including threats, will result in the account being closed immediately.

Acceptable use

You agree not to:

• try to reach another business’s information, or any part of the Portal you have not been given;
• probe, scan or test the Portal’s security, or get around any limit or protection on it;
• upload anything harmful, unlawful, or that you do not have the right to share;
• use automated tools to submit requests or collect data from the Portal;
• resell or reuse any part of the Portal without our written permission.

If you find a security problem, please tell us at parts@mauricetowntruck.com instead of testing it further. We appreciate it.

Changes to the Portal

We may change, add or remove features of the Portal, or stop offering it, temporarily or permanently. Where a change affects how you work with us, we will try to give notice first. If the Portal is unavailable, you can always reach the parts desk by phone.

Privacy and security

1. We handle your information as described in our Privacy Policy and Cookie Notice, and for no other purpose. We do not sell your information.
2. Our staff look at your account only to do the work you have asked of us (pricing a quote, ordering parts, answering a question), to fix a problem, to keep the Portal secure, or when the law requires it.
3. We protect your information with encryption in transit, access controls, and by keeping each business’s information separate. No system is perfectly secure, and we cannot promise that yours will never be accessed without permission; if it is, we will tell you as the law requires.
4. We use outside providers for hosting, the database, file storage and email. They are listed in the Privacy Policy.

Your content and ours

1. What you submit (requests, truck details, notes, feedback) stays yours. You give us permission to use it to provide the Portal and the parts and services you ask for.
2. Feedback and suggestions you send about the Portal itself we may use to improve it, without owing you anything for them.
3. The Portal, its design and its software belong to us or our licensors. Using it does not give you any ownership of it.

The Portal is provided “as is”

We build and test the Portal with care, but like any software it will have bugs. The Portal is provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent the law allows. This is about the website. Warranties on the parts you buy from us are separate and are not affected.

Liability

To the fullest extent permitted by law, we are not liable to you or anyone else for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill, use or data, arising from your use of, or inability to use, the Portal, from unauthorized access to or alteration of your transmissions or data, or from any other matter relating to the Portal, whether based on contract, tort (including negligence) or any other theory, even if we have been told such damages are possible. Our total liability for any claim relating to the Portal is limited to the greater of one hundred U.S. dollars or the amount you paid us for the specific order the claim concerns.

Some places do not allow some of these limits. Where that is so, they apply only as far as the law allows. Nothing here limits liability that cannot be limited by law.

Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in New Jersey, and you and we both agree to those courts’ jurisdiction.
